1. Acceptance of Terms

By accessing and using Moithuti, you agree to be bound by these Terms and Conditions, our Privacy Policy, and Cookie Policy. If you do not agree with any part of these terms, you may not use our platform.

2. Account Registration

You must provide accurate and complete information during registration.

You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities that occur under your account.

You agree not to share your account details with others or use another person's account without permission.

3. Use of the Platform

Moithuti is designed for educational purposes. You agree to use the platform in accordance with applicable laws and regulations.

You must not use the platform to engage in any illegal or harmful activities, including harassment, fraud, or uploading malicious software.

The content provided on the platform, including course materials and interactive features, is for personal, non-commercial use unless explicitly stated otherwise.

4. User Content

You retain ownership of the content you submit (e.g., assignments, notes, discussions), but by submitting content, you grant Moithuti a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your content on the platform.

You are solely responsible for any content you upload or submit and agree not to submit content that is offensive, inappropriate, or violates the rights of others.

5. Payments and Subscriptions

Certain features or courses may require payment. All fees are non-refundable unless otherwise stated.

You are responsible for any charges or fees associated with accessing premium content, as outlined on the payment page.

We may modify our pricing structure at any time with reasonable notice.

6. Termination

We reserve the right to suspend or terminate your account if you violate these Terms and Conditions or engage in activities that harm the platform or its users.

You may terminate your account at any time by contacting customer support.

7. Intellectual Property

All intellectual property rights related to the platform, including trademarks, logos, and course materials, are owned by Moithuti or its licensors.

You agree not to copy, distribute, or modify any content on the platform without prior written permission.

8. Limitation of Liability

Moithuti is provided "as is" without any warranties. We do not guarantee uninterrupted service or that the platform will be free from errors.

We are not responsible for any losses or damages resulting from your use of the platform, including data loss, technical issues, or unauthorized access to your account.

9. Changes to the Terms

We may update these Terms and Conditions from time to time. We will notify you of significant changes via email or through the platform. Your continued use of the platform following changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the Republic of Botswana. Any disputes arising from or related to these terms shall be resolved in accordance with the laws of Botswana.

Privacy Policy

1. Information Collection

We collect personal information that you voluntarily provide when using Moithuti LMS, including but not limited to contact information, account details, and learning preferences.

2. Use of Information

The information we collect is used to provide and improve our services, communicate with you, personalize your learning experience, and comply with legal obligations.

3. Data Security

We implement appropriate security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction.

4. Cookies

Moithuti LMS uses cookies to enhance your experience on our platform. These include:

• Authentication cookies: To recognize you when you log in.
• Preference cookies: To remember your settings (e.g., language preference).
• Analytics cookies: To analyze platform traffic and usage to improve services.
• Marketing cookies: To provide you with relevant advertisements and content based on your usage.

Cookies may be session-based (temporary) or persistent, and may include third-party cookies for analytics or marketing purposes.

Refund Policy

1. Eligibility for Refunds

Refunds are available only for subscription-based services (monthly, quarterly, or annual).

Refunds will not be issued for services accessed through promotions, discounted offers, or complimentary trials.

2. Refund Request Period

A refund request must be submitted within 7 days of the initial payment for monthly subscriptions and within 14 days for quarterly or annual subscriptions. Requests made after these periods will not be eligible for a refund.

3. Conditions for Full Refund

You are entitled to a full refund if you have not used Moithuti services extensively during the refund request period. Extensive use includes:

• Completing quizzes or assessments.
• Engaging with the chatbot for personalized assistance.

4. Partial Refunds

If you have used more than 30% of the platform's services but less than 60%, you may be eligible for a 50% refund. No refunds will be provided if more than 60% of the services have been used during the refund period.

5. Refund Process

To request a refund, please contact support@moithuti.com with your account details, proof of payment, and the reason for the refund request. Refund requests will be reviewed and processed within 7-10 business days from the date of submission. Approved refunds will be issued to the original payment method used during the purchase.

6. Non-Refundable Items

• Customized services, including tailored learning plans or private tutoring sessions, are non-refundable.
• Refunds are not available for technical issues or interruptions caused by factors beyond Moithuti's control, such as network problems or device malfunctions.

7. Cancellation Policy

Subscriptions can be canceled at any time, but canceling does not guarantee a refund unless it falls within the refund request period and meets the refund conditions outlined above. Upon cancellation, you will retain access to Moithuti's services until the end of the current billing cycle.

8. Amendments

Moithuti reserves the right to update or amend this refund policy at any time. Changes will be posted on our website, and it is the user's responsibility to review these changes.
